LYNCHBURG, Va. (WSET) — A trial is underway for the Lynchburg man charged with killing another man at the Dollar General on Boonsboro Road back in July 2022. Caleb Spinner is charged with second-degree murder and multiple firearm charges in the killing of Trevor Weeks.
Thursday, after selecting the jury, the prosecution and defense both gave their opening statements and then we heard from a few witnesses who were at the scene that day.
Defendant Caleb Spinner worked at Dollar General as the assistant manager during that time. The store manager testified Thursday that Weeks, who was killed, was at the store drinking and asking customers for rides. He said he called 911 after he and Spinner had asked Weeks to leave the store multiple times.

Security video played shows Weeks coming into the store with a drink. He spins the grocery bag dispenser a few times before they all go outside.
A few minutes later, you can see Spinner with a gun in hand, walking back into the store. Weeks walks towards him, and as Weeks puts his hand in his own pocket, Spinner shoots at him multiple times.
The prosecution is arguing that Weeks had no weapon and Spinner shot at Weaks until the gun was empty. They claim Spinner did this because Weeks was drinking and being annoying.
Spinner’s attorneys claim he was acting in self-defense and Spinner thought Weeks was pulling a weapon out when he began shooting at him.
Court will resume Friday morning and could potentially pick up again on Monday, depending on how long the evidence and the jury take.
